Compartmentalization Structured Candidate Selection untuk Fungsionalisasi Partai Politik dalam Pilkada Berbasis Good Election

Abstract

The practice of political dynasties in Indonesia has continued to grow following Constitutional Court Decision No. 33/PUU-XIII/2015, which eliminated the requirement of "no conflict of interest with incumbents" in regional head candidacies. This condition poses a serious challenge to the role of political parties as pillars of democracy, particularly in ensuring a high-quality political recruitment process. This legal research aims to analyze the legal implications of the decision and to identify and evaluate the compartmentalization model based on structured candidate selection as a means of political party functionalization to prevent conflicts of interest in regional head candidacy. The research uses a conceptual and normative approach through legal document and literature studies. The findings show that the removal of the "no conflict of interest with incumbents" requirement creates a legal space for political dynasty practices, which contradict constitutional democracy. Therefore, political parties need to adopt three key dimensions in candidate selection: neutrality, integrity, and transparency, and implement the compartmentalization recruitment model through five main aspects: reason, adaptation, goal attainment, integration, and latency. In this way, political parties can strengthen the function of political cadre formation in line with the principles of a good election.
