Peran Pancasila Dalam Pembentukan Peraturan Hukum di Indonesia

Abstract

Pancasila holds a fundamental position as the state ideology and the source of all sources of law within Indonesia’s legal system. This study aims to analyze the role of Pancasila in the formation of legal regulations in Indonesia. The study employs a descriptive qualitative method through a literature review of books, journals, laws and regulations, and other relevant sources. The findings indicate that Pancasila represents the crystallization of values that have developed within Indonesian society through customs, culture, religion, and social practices. These values serve as a foundation for lawmaking to ensure that regulations reflect justice, humanity, unity, democracy, and the interests of society. Therefore, Pancasila functions as a guideline for establishing legal regulations that provide not only certainty and order but also reflect the character and ideals of the Indonesian nation. Furthermore, incorporating Pancasila values into the legislative process is essential to maintaining consistency between legal norms, constitutional values, and societal needs. Thus, Pancasila-based lawmaking can strengthen a national legal system that is just, democratic, and oriented toward public welfare.
